Terms of Service

Welcome to UGig ("Platform", "we", "us", or "our"), operated by UGig LLC. These Terms of Service ("Terms") govern your access to and use of the UGig website at ugig.org and any related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years of age to use UGig. By creating an account, you represent that you are at least 18 years old. Students must use a valid .edu email address to register as a verified student and access certain features such as posting and accepting gigs.

2. Account Registration

You must provide accurate, complete, and current information when creating your account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that provide false information, violate these Terms, or engage in fraudulent or abusive behavior.

3. How UGig Works

UGig is a marketplace that connects people who need help with short-term tasks ("Posters") with college students who want to earn money by completing those tasks ("Students"). UGig facilitates the connection between Posters and Students but is not a party to any agreement between them.

  • Posters can create and publish gig listings describing tasks they need help with and the price they are willing to pay.
  • Students can browse, apply for, and complete gigs to earn money.
  • UGig provides tools for communication, payment processing, and dispute resolution but does not employ, supervise, or control any Student.

4. Payments and Fees

4.1 Platform Fee

UGig charges a platform fee of 15% on every completed gig transaction. This fee is deducted from the total gig price before the remaining amount is paid to the Student.

4.2 Escrow

When a Poster accepts a Student for a gig, the full gig price is charged and held in escrow by our payment processor, Stripe. The funds are only released to the Student after both the Poster and Student confirm that the gig has been completed satisfactorily.

4.3 Payouts

Students receive payouts to their connected bank account via Stripe Connect. Students are responsible for providing accurate banking information. Payout timing is subject to Stripe's processing schedule.

4.4 Refunds and Cancellations

Either party may cancel a gig before it is marked as completed. If a gig is cancelled while funds are held in escrow, the full amount will be refunded to the Poster. Once both parties have confirmed completion, the transaction is final and non-refundable except in cases of fraud or dispute resolution by UGig.

5. User Conduct

You agree not to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Post false, misleading, or fraudulent gig listings
  • Harass, threaten, or abuse other users
  • Circumvent the payment system by arranging payment outside of UGig
  • Create multiple accounts for the purpose of manipulation or fraud
  • Spam, post duplicate listings, or engage in any form of platform manipulation
  • Share your account credentials with others
  • Post gigs involving illegal activities, dangerous tasks, or anything that violates university policies
  • Use the platform to discriminate against any person based on race, gender, religion, sexual orientation, disability, or any other protected characteristic

6. Disputes

If a dispute arises between a Poster and a Student regarding a gig, either party may file a dispute through the UGig platform. UGig will review the dispute and may, at its sole discretion, issue a refund to the Poster, release payment to the Student, or take other appropriate action. UGig's decision on disputes is final.

7. Reviews and Ratings

After a gig is completed, both parties may leave reviews and ratings. Reviews must be honest, accurate, and based on the actual gig experience. UGig reserves the right to remove reviews that are fraudulent, abusive, or violate these Terms.

8. Intellectual Property

The UGig name, logo, and all related content, features, and functionality are owned by UGig LLC and are protected by copyright, trademark, and other intellectual property laws. You may not use our trademarks without prior written consent.

9. Limitation of Liability

UGig is a platform that facilitates connections between Posters and Students. We are not responsible for the quality, safety, legality, or completion of any gig. To the maximum extent permitted by law, UGig shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses resulting from your use of the Service.

Users are solely responsible for their interactions with other users. UGig does not conduct background checks on users and makes no guarantees about the identity or trustworthiness of any user.

10. Indemnification

You agree to indemnify, defend, and hold harmless UGig LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Independent Contractor Status

Students using UGig are independent contractors, not employees of UGig or any Poster. UGig does not control the manner or method by which Students complete gigs. Students are responsible for their own taxes, including self-employment taxes, and for complying with all applicable laws and regulations.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or through the Service. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

13. Termination

We may suspend or terminate your account at any time, with or without cause, with or without notice. Upon termination, your right to use the Service will immediately cease. Any pending escrow payments will be handled in accordance with Section 4.4.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in the State of Florida.
